These Terms and Conditions ("Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and Better App Information Technology LLC, a limited liability company incorporated under the laws of the United Arab Emirates, with its registered office located at Dubai Hills Business Park, Building 1, Office 104, Dubai, UAE ("Company," "we," "our," or "us").

This Agreement governs your access to and use of all software, mobile applications, software-as-a-service (SaaS) products, websites, and related digital services (collectively, the "Services") offered by Better App Information Technology LLC. By engaging with our Services, you confirm that you understand, accept, and agree to comply with the terms laid out below.

1. Acceptance of Terms

By accessing or using our Services in any manner, including but not limited to visiting our websites, downloading or using our mobile applications, or registering for an account, you agree to be bound by this Agreement and all applicable laws and regulations. If you do not agree with these Terms, you must not use or access the Services.

This Agreement applies to all users, including but not limited to visitors, registered users, and customers. If you are acting on behalf of a company or other legal entity, you represent and warrant that you have full authority to accept these terms on behalf of that entity. Continued use of our Services implies ongoing acceptance of any changes made to this Agreement.

2. Description of Services

Better App Information Technology LLC provides a variety of digital tools and services, which include but are not limited to:

• Mobile applications for personal and professional use across various platforms such as iOS and Android;
• Software-as-a-service (SaaS) platforms that support business operations, automation, data analytics, and productivity;
• Web applications accessible via modern browsers designed for consumer or enterprise use.

The features of our Services may vary depending on the plan or tier selected. Services may include user interfaces, APIs, backend systems, analytics dashboards, reporting tools, and integration capabilities with third-party systems. We retain the right to add, modify, or discontinue any feature or part of our Services at our discretion and without prior notice.

3. User Accounts

To access certain Services, you may be required to create an account by providing personal and/or business information. You agree to:

• Provide true, accurate, current, and complete information during the registration process;
• Maintain and promptly update your account information as needed;
• Be fully responsible for all activities that occur under your account, whether authorized or unauthorized;

You acknowledge that Better App Information Technology LLC is not liable for any loss or damage arising from your failure to comply with these requirements. You may not use another user's account without permission. We reserve the right to disable or suspend accounts that violate our terms.

4. Subscription, Fees, and Payment Terms

Certain Services require payment. By purchasing or subscribing to these Services, you agree to:

• Pay all applicable fees, taxes, and charges associated with your selected plan or service tier;
• Authorize us to charge your chosen payment method on a recurring basis, where applicable;
• Acknowledge that prices may change upon renewal and that we will notify you in advance of any pricing changes.

Late payments may result in service restrictions or termination. Subscription plans are billed in advance and may auto-renew unless explicitly cancelled by the user before the renewal date. Please refer to our Refund Policy for conditions related to cancellations and returns.

5. Acceptable Use

You agree to use our Services only for lawful and intended purposes. Specifically, you agree not to:

• Violate any applicable laws or regulations;
• Infringe upon the intellectual property or privacy rights of others;
• Distribute spam, viruses, malware, or other harmful or disruptive content;
• Attempt to gain unauthorized access to our systems or other users' accounts;
• Circumvent security features, misuse authentication credentials, or test system vulnerabilities;
• Use automated means (bots, scrapers) to access the Services without express written permission.

Your use of the Services must comply with community standards and applicable local and international laws. Violation of these guidelines may result in suspension, account termination, or legal action.

6. Intellectual Property Rights

All intellectual property rights in the Services, including software code, databases, content, visual design, branding, logos, and documentation, are the property of Better App Information Technology LLC or its licensors.

Except as explicitly permitted under this Agreement, you may not copy, modify, distribute, reverse engineer, or create derivative works from the Services. You may only use the Services for their intended purpose and within the scope of your license or subscription. Unauthorized use of our intellectual property is strictly prohibited and may result in legal action.

7. Privacy and Data Protection

We respect your privacy and are committed to protecting your personal data. Our Privacy Policy explains how we collect, use, disclose, and store personal information in compliance with applicable UAE data protection laws.

By using the Services, you consent to the collection and use of your information as described in our Privacy Policy. We employ industry-standard security measures to safeguard your data, but we cannot guarantee absolute security. Users are responsible for securing their own devices and login credentials.

8. User-Generated Content

Some Services may allow you to post, submit, or upload content such as text, images, feedback, reviews, or other materials ("User Content"). You retain ownership of your User Content, but by posting it, you grant Better App Information Technology LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display such content as part of the Services.

You represent and warrant that:

• You own or have the necessary rights to submit the content;
• The content does not infringe on any third party's rights;
• The content is not unlawful, defamatory, or harmful.

We reserve the right to remove any content that violates these Terms, community standards, or applicable laws. We are not liable for any loss or damage arising from the content submitted by users.

9. Termination

We may suspend or terminate your access to the Services for any reason, including but not limited to violation of these Terms, suspected fraudulent activity, or prolonged account inactivity.

Upon termination, your right to use the Services ceases immediately. Any licenses granted under this Agreement shall terminate, and you must delete any downloaded or stored copies of our software or content. Provisions that by their nature should survive termination (e.g., indemnification, limitation of liability) shall remain in effect.

10. Disclaimers

We strive to provide high-quality and reliable Services, but we do not guarantee that our Services will be error-free, uninterrupted, or fully secure. All Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

To the maximum extent allowed under law, we disclaim all warranties, including but not limited to fitness for a particular purpose, merchantability, and non-infringement. Your use of the Services is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Better App Information Technology LLC, its officers, directors, employees, or affiliates shall not be liable for:

• Any indirect, incidental, punitive, special, or consequential damages;
• Loss of profits, revenue, data, or goodwill;
• Damages resulting from unauthorized access, use, or alteration of your data.

Our total liability arising from or relating to these Terms is limited to the total amount paid by you for the Services in the three (3) months prior to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Better App Information Technology LLC and its affiliates, partners, and personnel from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of:

• Your use of or inability to use the Services;
• Your User Content;
• Your violation of these Terms or applicable law;
• Any third-party claims related to your conduct or content.

This indemnity obligation will survive the termination of this Agreement.

13. Governing Law and Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of the United Arab Emirates, specifically the laws of the Emirate of Dubai.

Any disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the courts of Dubai. We encourage users to contact us first to attempt a resolution before initiating formal legal proceedings.

14. Amendments

We may update or revise these Terms periodically. Changes will take effect upon posting on our website or within our applications. It is your responsibility to review these Terms regularly. Continued use of the Services constitutes acceptance of the updated Terms.

In the event of significant changes, we may notify you through email, in-app notifications, or other prominent communication methods.

15. End User License Agreement (EULA)

By downloading, installing, or using our software applications, you agree to this EULA:

• You are granted a limited, non-exclusive, non-transferable, revocable license to use the software on authorized devices;
• You may not rent, lease, sublicense, distribute, or otherwise transfer the software;
• You may not modify, reverse engineer, or attempt to extract the source code.

Violations of this EULA may result in the termination of your rights and legal consequences. All rights not expressly granted are reserved.

16. Refund Policy

We want you to be satisfied with our Services. Our refund policy is as follows:

• Subscription Services: Monthly subscriptions are generally non-refundable. Annual subscriptions may be eligible for pro-rata refunds if cancelled within 14 days of purchase.
• One-Time Purchases: Refunds may be issued for technical failures or accidental purchases, if requested within 7 days.
• Disputed Charges: Contact our support team for resolution. We may request documentation to verify your claim.

All refunds are issued at our discretion and processed through the original payment method.
